Terms of Use

The owner of the online shop tiki.ee (hereinafter the Online Shop) is Bestnet AS (registry code 10261109), registered office at Rae 4, Paldiski, Lääne-Harju rural municipality, Harju county 7680

Validity of the sales and purchase agreement and information about goods and prices

The order placed by the Client constitutes an agreement of sale and purchase between the Online Shop and the Client. The ordering terms and conditions apply to purchasing goods from the Online Shop. If necessary, the Online Shop reserves the right to cancel the order by giving the Client advance notice.

The prices of the products sold in the Online Shop are in euros and indicated next to the products. The prices include VAT.

A delivery fee shall be added to the price. The Client pays the shipping costs. The delivery fee depends on the location of the Client and the delivery method chosen.

The delivery fee is displayed to the Client when the order is placed.

Product information is provided in the Online Shop right next to the product.

Placing an order

Only Clients who are of full age and with active legal capacity can place an order.

The Client must examine the description of the product and the terms of delivery. To order a product, click on the ‘Add to cart’ button. By clicking on the ‘Cart’, the Client can see their entire shopping cart with the amount to be paid.

To finalise the order, the Client’s data must be entered in the required fields and a suitable delivery method chosen. The Client will then be shown their cart total, including the delivery fee. Before confirming the final purchase, the Client must make sure that the details entered, both for the product selected and for the Client’s data, are correct.

By placing an order, the Client acknowledges that the order entails a payment obligation. By ticking the corresponding box, the Client confirms that they have examined the ordering terms and conditions governing the Website.

You can pay for the order via a bank link or on the basis of an invoice. The invoice will be sent to the Client by e-mail.

The agreement enters into force after the amount due is credited to the bank account of the Online Shop.

After placing the order, the Client will receive a confirmation e-mail listing the product(s) ordered, the chosen delivery method and address, the payment conditions and the estimated delivery time. If the Client finds any mistakes in the confirmation letter, they must immediately notify the Online Shop by e-mail or telephone.

Delivery

Goods are delivered within the borders of Estonia.

You can buy products as long as they are available.

The Online Shop has the right to withdraw from the agreement if the ordered product cannot be delivered because it is out of stock or for any other reason. The Online Shop shall notify the Client of the withdrawal from the agreement at the earliest opportunity by telephone or e-mail. The amount paid for the goods (including the delivery fee) shall be refunded immediately within 14 days of receipt of the notification.

The delivery guarantee is indicated on the product. The delivery guarantee is indicative and may vary by a few days depending on holidays and unforeseen circumstances. Shipments in Estonia generally reach the destination determined by the Client within 3-7 working days as of entry into force of the agreement.

The Online Shop has the right to deliver goods within up to 45 calendar days in exceptional cases.

The Online Shop reserves the right to split orders for products with different delivery times and to deliver products in multiple stages.

Delivery via Omniva parcel machines. The goods are delivered only after the full amount payable for the order is credited to the account of the Online Shop. Upon arrival of the goods, the Client will receive a text message and/or an e-mail specifying the location of the parcel machine, the door code, the return code and the maximum storage period. To retrieve your parcel, enter the door code on the screen, wait for the door to open and take the parcel out.

Delivery by Omniva courier. The goods are delivered only after the full amount payable for the order is credited to the account of the Online Shop. The courier will contact the Client to agree on the exact time of delivery using the telephone number provided in the order. The courier will deliver the parcel to the front door (i.e. the front door of an apartment building or the gate of a private residence), the transport price does not include floor charges. If the courier is unable to contact the Client on the number provided in the order, the parcel will be delivered to the nearest post facility and Omniva will send a notification to the Client, enabling the Client to collect the parcel from the post facility. The courier fee will not be refunded to the Client. If the Client would like to have the parcel re-delivered to their home address from the post facility, they must contact Omniva and order the corresponding service based on Omniva’s price list.

If you choose the ‘Pick up by myself’ delivery method, you can collect the goods from the brick-and-mortar shop/warehouse of the Online Shop:

Tiki shop at Kadaka tee 185, 12618 Tallinn. The shop is open Mon-Fri 9:00-17:00 This may vary depending on holidays. Once the parcel is ready for dispatch, the Client will receive an e-mail notice and/or a telephone call. Goods are not handed over outside the opening hours of the brick-and-mortar shop.

Tiki warehouse at Rae 4, 76805 Paldiski. The warehouse is open Mon-Fri 8:00-16:00. Once the parcel is ready for dispatch, the Client will receive an e-mail notice and/or a telephone call. Goods are not handed over outside the opening hours of the warehouse.

Tiki warehouse at Gaasibaasi tee, Vana-Kuuste village, Kambja rural municipality, Tartu county. The warehouse is open Mon-Fri 8:30-16:30. Once the parcel is ready for dispatch, the Client will receive an e-mail notice and/or a telephone call. Goods are not handed over outside the opening hours of the warehouse.

Once the order is paid for, the goods can be kept in the warehouse of the Online Shop for 7 days. A storage fee of 1% of the cost of the goods per day is added to the cost of the goods from the 8th day.

 

Right of withdrawal

Once the order has been received, the Client has the right to withdraw from the agreement entered into in the Online Shop within 14 days, except for trailers that have been assembled according to the Client’s wishes and/or registered with the Road Administration, where the right of withdrawal does not apply.

The right of withdrawal does not apply if the Client is a legal person.

To exercise the 14-day right of returns, the ordered goods may not be used in any other way than is necessary in order to examine the nature, properties and functioning of the goods in the same way this would be allowed for testing purposes in a physical shop.

If the products have been used in any other way than is necessary for the nature, characteristics or functionality of the goods or they have wear marks, the Online Shop has the right to reduce the refundable amount in accordance with the decrease in value of the goods.

To return the goods, the submit a return form that can be downloaded HERE, and send it to the e-mail address sales@tiki.ee within 14 days of receiving the goods.

The cost of returning the goods is borne by the Client unless the reason for return is the fact that the product to be returned does not correspond to what was ordered (an incorrect or faulty product).

The Client must return the goods within 14 days of submitting their application to do so or provide proof that the goods have been handed over to the carrier within that period.

Having received the returned goods, the Online Shop refunds the Client for any amounts received from the Client on the basis of the agreement immediately but no later than within 14 days of receiving the application for withdrawal.

The Online Shop may refuse to process the refund until it receives the item that is the object of the agreement or until the Client submits proof that the item has been sent back, whichever happens first.

If the Client, when placing the order, chooses a method of delivery different from the most inexpensive normal method of delivery offered by the Online Shop, the Online Shop is not required to refund to the Client the amount exceeding the cost of normal delivery.

The Online Shop has the right to withdraw from the sales transaction and request that the goods be returned by the Client if the price of the goods in the Online Shop is marked significantly lower than the market price of the goods due to an error.

Right to file complaints

The Online Shop is responsible for the non-compliance of goods sold to a Client with the terms of the agreement or for deficiencies which already existed at the time of delivery and which occur within two years of delivering the goods to the Client. Within the first six months of the delivery of the goods to the Client, it is presumed that the deficiency already existed at the time of delivery. The obligation to disprove this presumption lies with the Online Shop.

If a defect is discovered, the Client has the right to contact the Online Shop within no later than two months by sending an e-mail to the address sales@tiki.ee or calling 678 2064.

The Online Shop is not liable for defects occurring after the delivery of the goods to the Client.

If the goods purchased in the Online Shop have defects for which the Online Shop is liable, the Online Shop we will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Shop will refund all fees incurred under the sales agreement to the Client.

The Online Shop responds to the consumer’s complaint within 15 days in writing or in a form reproducible in writing.


Disposing of disputes

If the Client has any complaints about the Online Shop, these should be sent at sales@tiki.ee or reported by phone 678 2064 If the Client and the Online Shop fail to resolve a dispute by reaching an agreement, the Client has the right to turn to the Consumer Disputes Committee. The Consumer Disputes Committee is authorised to resolve disputes arising from the agreement entered into between the Client and the Online Shop. There is no charge for the Commission to review a Client’ s complaint.

The Client may use the EU Consumer Dispute Resolution Platform.
